Product Liability Lawsuits Involving Health and Personal Safety
Some instances of defective products have relatively minor implications. Other times, a misrepresented product or a product that is defective can be detrimental to a person’s health or safety.
When a person suffers harm because of a defective product and his or her life is negatively impacted, there may be grounds for a personal injury claim – more specifically, a product liability lawsuit.
There are plenty of recent cases in the news to illustrate how the use of a product can negatively impact people’s lives. The vaginal mesh class action lawsuits, the DePuy hip replacement suits , and Yasmin and Yaz birth control lawsuits, all show how damaging certain products can be when they have negative side effects, when they malfunction, or when they have some inherent defect. In using these medical devices, patients developed serious blood clots (birth control), needed multiple surgeries to remove the devices which caused internal damage and pain (vaginal mesh), or needed surgical revisions (DePuy hip replacement device).
Health concerns are not the only type of issue people have. Another product liability lawsuit in Ohio did not claim that anyone suffered physical injury, but that a product compromised the safety and property of those using it. The suit was brought against Kaba, a leader in the lock industry. Kaba made Simplex push-button locks that were marketed as being extremely safe and vandal resistant. The locks ranged in cost from under $200 to upwards of $1000 and came in several different models. Hospitals, airports, casinos, banks, the Department of Defense, and police departments all used these locks. Many people used them on their homes and businesses.
It turned out that these locks could easily be breached with a $30 magnet. The lawsuits brought against the Kaba company claimed common-law fraud, deceptive trade practices, and negligence resulting in product liability action. The hundreds of thousands of lawsuits brought against the company were consolidated into one class action lawsuit.
Lawyers for the plaintiffs demanded that the locks be replaced by Kaba, that they turn over profits that were made from selling the defective locks, and that compensatory damages be paid.
When a product promises to enhance security and it is discovered that the product itself is unsound, it should be greatly unsettling for consumers who paid money for that product and relied on it for protection.
In instances like these, the legal system can offer consumers a way to recover what has been lost, get money back, or be otherwise compensated for the damage or injury that the product has caused.
