A man in Clearwater, Florida was arrested earlier this year and accused of sexually abusing a nursing home patient who had recently suffered a severe stroke. The 70-year-old man was arrested on April 25 and booked into the Pinellas County Jail after accusations of sexual abuse were issued. The man was accused of abusing an elderly nursing home resident back in October. He was charged with sexual battery on a person who is physically helpless.
This man is himself a resident of the Easy Bay Rehabilitation Center and was allegedly seen by a certified nursing assistant entering the room of another resident around 6 p.m. on October 24, 2012. The nursing assistant reported the incident to other staff members who went to investigate immediately. They say they walked in on the man sexually molesting the victim; when they confronted him he acted very surprised and confused, and tried to flee but ran into a dresser.
The woman who he victimized had suffered a recent series of strokes and was in recovery but was unable to communicate. She was unable to consent to any form of sexual activity, according to police.
When questioned about the incident, the man remained confused. He says that he understands that his actions were wrong, but that he does not know why he did what he did.
Missouri Nursing Home Abuse Lawyers
Anyone who has suffered abuses at the hands of another resident or nursing home staff member should immediately contact an experienced nursing home abuse attorney. Nursing home abuse is a serious offense and each instance should be investigated by the state. Victims also have the option of taking civil action against an abuser.
Recognizing and reporting abuse is extremely important in protecting residents from egregious abuses. If you suspect abuse or know that abuse has occurred, contact a nursing home abuse attorney to discuss your options. If you or your family has experienced nursing home abuse, a nursing home abuse attorney can help you to seek justice and obtain the compensation that you deserve.
Fortunately a staff member noticed that something was amiss and was able to prevent the incident from going any further, but when the abuse is perpetrated by nursing home staff, it can be more difficult to spot and prevent. Families who have loved ones in a nursing home should monitor the care that they receive carefully and learn to recognize signs of abuse as a way to protect family members and stay safe. Not every resident can advocate for themselves, so you should be aware of changes in behavior or physical signs of abuse like bedsores. If you notice anything out of the ordinary, report it to the nursing home and the state.
You should also contact a nursing home abuse attorney for advice. An attorney can help to investigate, uncover, and protect evidence that can be used in a civil case against the abuser and in some cases the nursing home.
